Website terms of service

Baseline terms. These terms cover use of the Kowdja public website, demo bookings, and any free trial. A separate written Master Services Agreement will apply once your business signs up as a paying merchant on Kowdja.

1. About us

This website is operated by Kowdja, a partnership established in Malta, with its place of business at Flat 2, 50, Triq il-Ħarifa, Mosta MST 4043, Malta, and Maltese VAT number MT3270-4603 ("Kowdja", "we", "us"). You can reach us at hello@kowdja.com.

2. Acceptance of these terms

By visiting kowdja.com or any of its sub-pages, by booking a demo, or by using any free trial of our products, you accept these terms and our Privacy policy. If you don't accept them, please don't use the site.

3. What we offer through the website

  • Information about Kowdja and our products;
  • The ability to book a free online demo by submitting your name, email, and venue details;
  • The ability to contact us.

Live paid use of Kowdja POS or our other products is governed by a separate agreement which we'll send you to sign before the product goes live.

4. The demo

The demo is a free, no-obligation, online walkthrough of our products typically lasting 30 minutes. You'll receive an email confirmation with a calendar invite and a meeting link. If we have to reschedule for any reason, we'll let you know in good time and ask you to pick a new slot. The demo is provided "as is" for information purposes only — nothing said during a demo amounts to a binding commitment by either side unless put in writing.

5. Your obligations

When using the website or booking a demo you agree to:

  • Give accurate and current information about yourself and your business;
  • Not impersonate anyone else;
  • Not use the site or our products for any unlawful, harmful, fraudulent, infringing or abusive purpose;
  • Not attempt to gain unauthorised access to any part of the site, our infrastructure, or any account you don't own;
  • Not scrape, crawl, mirror or copy any part of the site at a rate or volume that could affect its availability for other users;
  • Not introduce viruses, trojans, worms, logic bombs, or any other malicious or harmful material to the site.

We may suspend or terminate your access without notice if we reasonably believe you have breached these terms.

6. Intellectual property

The Kowdja brand, the Kowdja word and chevron marks, our software, and all content on this website (text, graphics, layouts, code) are owned by Kowdja or our licensors and are protected by Maltese and international copyright, trade-mark and other intellectual property laws.

You may view, link to, and share normal portions of our public website for non-commercial purposes. Anything beyond that — reproduction, redistribution, public display, modification, or use of any of our content or marks — requires our prior written permission.

If you give us feedback, suggestions or ideas about our products, you grant us a perpetual, worldwide, royalty-free licence to use them without obligation to you.

7. Third-party links

Our site may link to external websites and services we don't control. We don't endorse those sites and aren't responsible for their content, privacy practices, or availability.

8. No warranty

The website and any free demo or trial are provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties, conditions and representations, whether express or implied, including (but not limited to) any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or that the site will be uninterrupted, secure or error-free.

9. Limitation of liability

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under Maltese law — including, where applicable, liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.

Subject to that, to the maximum extent permitted by law:

  • We will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, revenue, goodwill, opportunity, data, or business interruption, arising out of or in connection with your use of the website or any free demo;
  • Our total aggregate liability for all claims arising out of or in connection with your use of the website or any free demo will not exceed EUR 100 or the amount you have paid us in the 12 months preceding the claim (whichever is greater).

If you are using the site as a consumer (rather than for business purposes), your statutory consumer rights are not affected.

10. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these terms or your unlawful use of the website.

11. Privacy and cookies

How we handle personal data is set out in our Privacy policy and our Cookie policy. They form part of these terms.

12. Changes to these terms

We may update these terms from time to time. The current version is always available at this URL with its "Last updated" date. Continuing to use the site after we publish updated terms means you accept them.

13. Termination

You can stop using the site at any time. We can suspend or terminate your access to the site, your demo booking, or any free trial at any time and without notice if you breach these terms, or for any other reason we reasonably consider justified.

14. Force majeure

Neither party will be liable for any failure to perform its obligations under these terms (other than payment obligations, where applicable) caused by an event beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, fires, floods, accidents, strikes, or shortages of transport, fuel, energy, labour or materials.

15. Severability and waiver

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision in these terms will not be deemed a waiver of that right or provision.

16. Entire agreement

These terms, together with our Privacy policy, Cookie policy and any other notice we link to from this site, are the entire agreement between you and Kowdja in respect of your use of the website and any free demo, and supersede any prior agreement on that subject.

17. Governing law and jurisdiction

These terms are governed by, and will be interpreted in accordance with, the laws of Malta. Any dispute arising out of or in connection with these terms or your use of the website will be subject to the exclusive jurisdiction of the courts of Malta, save that we may bring proceedings against you in any other competent court if necessary to protect our rights.
